箱庭次元研究機構 利用規約（運用協定）

本規約は、箱庭次元研究機構（Arca Hortus Dimension Research Organization。以下「当機構」）が運営するウェブサイト「Arca Hortus」（以下「当拠点」）の利用条件を定めるものです。当拠点を閲覧または利用する全ての方（以下「ユーザー」）は、本規約に同意したものとみなします。

本規約において使用する用語の定義は、以下のとおりとします。

1. 「本コンテンツ」：当拠点上のテキスト、画像、音声、映像、プログラム、世界観設定、キャラクター、名称、ロゴ、および概念設計の一切をいいます。
2. 「箱庭世界」：当機構が創作・管理する架空の世界観、およびそれを構成する物語・設定群の総称をいいます。
3. 「二次創作」：本コンテンツに依拠し、その表現または設定を利用して新たに創作された作品をいいます。

当拠点はフィクション（創作）を含むエンターテインメントサイトであり、演出上「機密」「収容」「観測」等と表記される事項は、現実の権利義務に影響を与えるものではありません。現実に効力を有する条件は、本規約およびプライバシーポリシーに定めるところによります。

These Terms set out the conditions of use for the website "Arca Hortus" (hereinafter "the Outpost"), operated by the Arca Hortus Dimension Research Organization (hereinafter "the Organization"). All who view or use the Outpost (hereinafter "the User") are deemed to have consented to these Terms.

The terms used herein are defined as follows:
1. "the Content" — the whole of the text, images, audio, video, programs, worldbuilding, characters, names, logos, and conceptual design upon the Outpost.
2. "the Hakoniwa World" — the fictional world the Organization creates and keeps, together with the body of stories and settings that compose it.
3. "derivative work" — a work newly created in reliance upon the Content, drawing on its expression or its settings.

The Outpost is an entertainment site containing fiction. Matters written, for effect, as "classified", "contained", or "under observation" have no bearing upon rights or obligations in the real world. The conditions that do have real effect are those laid down in these Terms and in the Privacy Policy.

本コンテンツに係る著作権、商標権その他一切の知的財産権は、特段の表示がない限り、当機構または正当な権利を有する第三者に帰属します。本規約に基づく当拠点の利用許諾は、これらの権利をユーザーに移転または譲渡するものではありません。

ユーザーは、私的使用のための複製その他法令により認められる場合を除き、当機構の事前の許諾なく、本コンテンツを複製、転載、頒布、公衆送信、翻案、または解析（リバースエンジニアリングを含む）してはなりません。

当拠点の制作にあたり使用した音声・イラスト・生成AI素材・オープンソースソフトウェア（OSS）等のクレジットおよびライセンス表記は、クレジット・ライセンス一覧にまとめて掲載しています。

Copyright, trademark, and every other intellectual property right in the Content belongs, unless otherwise indicated, to the Organization or to a third party lawfully entitled to it. The permission to use the Outpost granted under these Terms does not transfer or assign any of those rights to the User.

Except for reproduction for private use and other cases permitted by law, the User may not reproduce, reprint, distribute, transmit publicly, adapt, or analyse (reverse engineering included) the Content without the Organization's prior permission.

Credits and licence notices for the audio, illustration, AI-generated material, open-source software, and the like used in making the Outpost are gathered on the Credits & Licences page.

当機構は、創作文化の発展を尊重し、非営利かつ「箱庭世界」の品位を損なわない範囲において、ユーザーによる二次創作活動を歓迎します。この場合、事前の連絡は不要です。

ただし、以下の行為には当機構の事前の書面（電磁的方法を含む）による許諾が必要です。

1. 法人その他の団体による利用、または個人による営利目的（商用）の利用。ただし、同人活動の慣行上相当と認められる範囲の頒布はこの限りではありません。
2. 公序良俗に反する態様、または本コンテンツ・キャラクターのイメージを著しく毀損する態様での利用。
3. 当機構の公式発表・公認であると誤認させるおそれのある態様での公開。
4. 本コンテンツの素材（画像・音声・プログラム等）をそのまま、または軽微な改変のみで利用する行為。

二次創作物に起因してユーザーと第三者との間に紛争が生じた場合、当該ユーザーは自己の責任と費用によりこれを解決するものとし、当機構は一切の責任を負いません。

The Organization holds the growth of creative culture in high regard, and welcomes derivative work by Users so far as it is non-commercial and does not diminish the dignity of the Hakoniwa World. In that case, no advance notice to us is required.

The following, however, require the Organization's prior permission in writing (electronic means included):
1. Use by a corporation or other body, or use by an individual for profit (commercial use). Distribution within the bounds customarily accepted in doujin activity is excepted from this.
2. Use in a manner contrary to public order and morals, or one that gravely damages the image of the Content or its characters.
3. Publication in a manner liable to be mistaken for an official announcement or endorsement by the Organization.
4. Use of the Content's materials (images, audio, programs, and so forth) as they are, or with only trifling alteration.

Should a dispute arise between a User and a third party on account of a derivative work, that User shall resolve it at their own responsibility and expense, and the Organization bears no responsibility whatsoever.

当拠点には、制作プロセスの一部としてAIを利用して生成されたコンテンツが含まれる場合があります。これらについても第2条の定めが適用されます。

ユーザーは、当機構の事前の明示的な許諾なく、本コンテンツを機械学習その他のAI開発のための訓練データとして利用し、またはそのためのスクレイピング・データセット化を行ってはなりません。当機構は、情報解析の用に供する場合であっても、著作権法第30条の4ただし書にいう「著作権者の利益を不当に害することとなる場合」に該当し得るものと考えます。

The Outpost may contain material generated with the aid of AI as part of the making of it. Article 2 applies to such material as well.

Without the Organization's prior and express permission, the User may not use the Content as training data for machine learning or other AI development, nor scrape it or compile it into a dataset for that end. The Organization takes the view that, even where the purpose is information analysis, such use may fall within the proviso to Article 30-4 of the Copyright Act — the case where the interests of the copyright holder would be unjustly harmed.

ユーザーは、当拠点の利用にあたり、以下の行為を行ってはなりません。

• 法令または公序良俗に違反する行為
• 犯罪行為に関連する行為、またはこれを助長する行為
• 当機構のサーバーまたはネットワークの機能を破壊・妨害する行為（過度なアクセス、脆弱性の探査を含む）
• 当機構または第三者の知的財産権、肖像権、プライバシー、名誉その他の権利・利益を侵害する行為
• 他のユーザーに関する個人情報等を不正に収集または蓄積する行為
• 当機構になりすます行為、または当機構との提携・協力関係を偽る行為
• 当拠点の運営を妨害するおそれのある行為、および政治的・宗教的勧誘行為
• 反社会的勢力に対する利益供与その他の協力行為
• その他、当機構が合理的な理由に基づき不適切（――記録上は「収容違反」と呼称されます）と判断する行為

ユーザーが本条に違反した場合、当機構は、事前の通知なく当該ユーザーによる当拠点の利用を制限し、または将来に向かって拒否することができます。

In using the Outpost, the User shall not:
- Act in violation of law or of public order and morals
- Engage in conduct connected with criminal activity, or which encourages it
- Destroy or obstruct the functioning of the Organization's servers or network (excessive access and probing for vulnerabilities included)
- Infringe the intellectual property, likeness, privacy, reputation, or other rights and interests of the Organization or of a third party
- Improperly collect or store personal information concerning other Users
- Impersonate the Organization, or misrepresent an alliance or cooperation with it
- Act in a manner liable to obstruct the running of the Outpost, or engage in political or religious solicitation
- Confer benefit upon, or otherwise cooperate with, antisocial forces
- Act in any other way the Organization judges, on reasonable grounds, to be improper — in the records, such an act is called a "containment breach"

Where a User violates this Article, the Organization may, without prior notice, restrict that User's use of the Outpost or refuse it going forward.

当拠点または当機構が指定する外部プラットフォームを通じて有料コンテンツ・物品（以下「有料サービス」）を提供する場合、ユーザーは当機構または当該プラットフォームが指定する決済方法により、代金を支払うものとします。

デジタルコンテンツの性質上、提供開始後のキャンセルおよび返金には原則として応じられません。ただし、法令に基づきユーザーに認められる権利（コンテンツの重大な欠陥に起因する場合等）を制限するものではありません。

有料サービスに関する販売条件の詳細は、各販売ページまたは特定商取引法に基づく表記に定めるところによります。

Where paid content or goods (hereinafter "Paid Services") are offered through the Outpost or through an external platform designated by the Organization, the User shall pay the price by the method of settlement specified by the Organization or by that platform.

Given the nature of digital content, cancellation and refund are as a rule not available once provision has begun. This does not, however, restrict any right afforded to the User by law — as where the content proves gravely defective.

The particular conditions of sale for Paid Services are as set out on each sales page, or in the notice given under the Act on Specified Commercial Transactions.

当機構は、以下のいずれかに該当する場合、ユーザーに事前に通知することなく、当拠点の全部または一部の提供を変更・中断・終了できるものとします。

1. システムの保守点検または更新を行う場合
2. 地震、落雷、火災、停電、天災、通信障害その他の不可抗力により提供が困難となった場合
3. その他、当機構が変更・中断・終了を必要と合理的に判断した場合

当機構は、本条に基づく変更・中断・終了によりユーザーに生じた損害について、当機構の故意または重過失による場合を除き、責任を負いません。

In any of the following cases, the Organization may alter, suspend, or discontinue the Outpost in whole or in part without prior notice to the User:
1. Where maintenance, inspection, or updating of the system is to be carried out
2. Where provision becomes difficult through earthquake, lightning, fire, power failure, natural disaster, communications failure, or other force beyond control
3. Where the Organization otherwise judges, reasonably, that alteration, suspension, or discontinuation is required

The Organization bears no responsibility for damage caused to a User by such alteration, suspension, or discontinuation, save where it arises from the Organization's intent or gross negligence.

当拠点または関連サービスにおいてユーザーがID・パスワード等の識別情報を登録する場合、ユーザーは自己の責任においてこれを管理するものとし、第三者への譲渡・貸与・共用をしてはなりません。識別情報が第三者に使用されたことによって生じた損害について、当機構は、当機構に故意または重過失がある場合を除き、責任を負いません。

Where a User registers identifying information such as an ID or password on the Outpost or a related service, the User shall manage it at their own responsibility, and shall not transfer, lend, or share it with a third party. The Organization bears no responsibility for damage arising from a third party's use of that information, save where the Organization has acted with intent or gross negligence.

当拠点には、Amazonアソシエイト、Google AdSense等の広告、および外部サイトへのリンクが含まれます。広告およびCookie等の取り扱いの詳細は、プライバシーポリシーに定めるところによります。

リンク先の外部サイトは当機構の管理下にはなく、その内容の正確性・安全性について当機構は保証しません。外部サイトの利用は、ユーザー自身の責任と当該サイトの定める条件に従って行ってください。

The Outpost carries advertising such as Amazon Associates and Google AdSense, together with links to external sites. The particulars of advertising and of cookies are as laid down in the Privacy Policy.

External sites reached by link are not under the Organization's control, and the Organization does not warrant the accuracy or safety of what they contain. Please use them at your own responsibility and according to the conditions each site sets.

当機構は、当拠点および本コンテンツについて、事実上または法律上の瑕疵（安全性、信頼性、正確性、完全性、有効性、特定目的への適合性、セキュリティ等に関する欠陥、エラーやバグ、権利侵害等を含む）がないことを、明示的にも黙示的にも保証しません。

当機構は、当拠点の利用によりユーザーに生じたあらゆる損害について、当機構の故意または重過失による場合を除き、責任を負いません。消費者契約法その他の法令により免責が認められない場合であっても、当機構の責任は、直接かつ通常の損害の範囲に限られ、かつ、有料サービスに関しては当該ユーザーが過去12ヶ月間に当機構に支払った金額を上限とします。

The Organization gives no warranty, express or implied, that the Outpost and the Content are free from defects in fact or in law — including defects of safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, or security, as well as errors, bugs, and infringements of rights.

The Organization bears no responsibility for any damage caused to a User through use of the Outpost, save where it arises from the Organization's intent or gross negligence. Even where such exemption is not permitted under the Consumer Contract Act or other law, the Organization's liability is confined to direct and ordinary damage, and, as regards Paid Services, is capped at the amount that User has paid to the Organization over the preceding twelve months.

本規約のいずれかの条項またはその一部が、法令等により無効または執行不能と判断された場合であっても、残りの条項および一部が無効等と判断された条項の残部は、継続して完全に効力を有するものとします。

Should any provision of these Terms, or part of one, be held invalid or unenforceable under law, the remaining provisions — and the remainder of any provision held partly invalid — continue in full force.

当機構は、以下の場合に、民法第548条の4の定型約款の変更に関する規定に基づき、ユーザーの個別の同意を得ることなく本規約を変更できるものとします。

1. 変更がユーザーの一般の利益に適合するとき
2. 変更が契約をした目的に反せず、かつ、変更の必要性、変更後の内容の相当性その他の事情に照らして合理的なものであるとき

本規約を変更する場合、当機構は、効力発生日を定め、変更内容および効力発生日を当拠点上で事前に周知します。効力発生日以降に当拠点を利用したユーザーは、変更後の規約に同意したものとみなします。

In the following cases, the Organization may amend these Terms without obtaining the individual consent of Users, in accordance with the provisions on standard-form contracts in Article 548-4 of the Civil Code:
1. Where the amendment conforms to the general interest of Users
2. Where the amendment does not contradict the purpose of the contract and is reasonable in light of the need for it, the appropriateness of the amended content, and other circumstances

When amending these Terms, the Organization will fix a date of effect and give notice beforehand upon the Outpost, stating what has changed and when it takes effect. A User who uses the Outpost on or after that date is deemed to have consented to the amended Terms.

本規約の準拠法は日本法とします。海外からの接続の場合も同様です。

当拠点に関してユーザーと当機構との間に紛争が生じた場合、まず誠実に協議のうえ解決を図るものとし、協議により解決しない場合は、当機構の所在地を管轄する地方裁判所を第一審の専属的合意管轄裁判所とします。

These Terms are governed by the law of Japan. This holds equally for connections made from outside the country.

Should a dispute arise between a User and the Organization concerning the Outpost, the two shall first confer in good faith to resolve it. Where conferring does not resolve it, the district court having jurisdiction over the location of the Organization shall be the exclusive court of agreed jurisdiction in the first instance.
